Purpose:

Tyndale University desires to be a hospitable and welcoming space but recognizes that measures may need to be taken from time to time to limit an individual's access to the Workplace and/or Study Space to ensure the health, safety and security of other Community Members and the facilities.  The purpose of this procedure is to document how a Persona Non Grata declaration will be made, how it will be communicated and how, a request can be made for a review.

Terms and Definitions:

Definition:

Behaviour Detrimental to the University and its Community Members “Behaviour Detrimental to the University and its Community Members” includes, but is not limited to, behaviour where:
  • there is reasonable grounds to believe the individual has the potential to engage in threatening or violent behaviour, and is likely to be present on University property;
  • an individual has engaged in, or is reasonably likely to engage in, criminal activity that may impact the University or Community Members;
  • an individual is in violation of a University policy and there are reasonable grounds to believe the individual has the potential to (or has) materially interfered with or impacted the University’s teaching and research mission, or use of the University’s property for such purposes; or
  • an individual is, or has engaged in, or is reasonably likely to engage in, conduct that threatens or endangers the health, safety or property of the University or of any person, including issues of domestic violence, sexual assault, discrimination and/or harassment.
Community Member includes full-time and part-time faculty and staff (including student workers), instructors, secondees, volunteers, contractors, consultants and students.
Employee means any full-time or part-time staff member, any full-time or part-time faculty, temporary or contract employee, volunteer or student worker.
PNG Persona Non Grata (PNG) is a documented University declaration, which describes official restrictions placed upon an individual who is denied the privilege of entering specific parts of the University or the University as a whole. If PNG declared individuals are found or seen in the area they are denied, then they may be subject to apprehension and charge by Tyndale University Security Services under the Trespass to Property Act, R.S.O. 1990.
Workplace and/or Study space means any land, premises, location or thing at, upon, in or near which a community member works or studies, whether physical or virtual. The workplace or study space includes, but is not limited to, the physical premises and the site of work or study-related social functions, work or study related assignments outside Tyndale’s premises and work or study-related conferences or training sessions.

Issuing PNG Declarations 

How / What to Do:

PNG Declarations are issued as a result of the submission and review of an incident report which identifies Behaviour Detrimental to the University and its Community Members. 
1.1.
Declaration Approval 

How / What to Do:

Those responsible for reviewing the University's incident reports should contact an Authorized Person listed in the Persona Non Grata Policy for the issuance of a PNG Declaration. Based upon information from the incident report an Authorized Person will complete the Persona Non Grata Declaration Letter Template.docx and forward it to University Security Services together with information on which of the University Community Members ought to be informed.

Warnings and/or Precautions:

It is critically important that the Authorized Person identify to University Security Services which department heads ought to be notified of a PNG declaration to protect Community Members and assist in the enforcement of PNG Declaration conditions. Below is a non-exhaustive list:
  1. For all Community Members
    • Director, Campus Operations
  2. For employees:
    • President
    • Provost
    • Senior Vice-President Administrative & Support Services
    • Human Resources
    • Direct Manager
  3. For students:
    • President
    • Provost
    • Vice President, Academic and Dean
    • Vice-President Student Development

Declaration Notifications 
1.2.1.
Notification to PNG Declared individual 

How / What to Do:

The completed and signed Persona Non Grata Declaration Letter should be sent to the PNG Declared individual by:
  • email; and
  • by registered mail

1.2.2.
Notification to University Community 

How / What to Do:

A summary of the PNG declaration which includes the individual's name, the specific areas of the Workplace and/or Study Space that they are prohibited from attending, the term of the conditions, along with instructions on who to contact in the event of a breach of these conditions should be sent by University Security Services to those identified by the Authorized Person.

It is not the responsibility of an Authorized Person to provide University Security Services with a complete list of every Community Member who needs to know about a PNG Declaration. Department heads share this responsibility with the Authorized Person and must use sound judgement in informing their team members on a need to know basis.

Handling Breaches 
2.1.
Verbal Reporting of Breaches 

How / What to Do:

University Security Services may be notified immediately by dialing 2222 from any University phone or by dialing 416-226-6620 ext 2222 of any individual who is in contravention of their PNG Declaration conditions.

If University Security Services is not available the Director, Campus Operations may be notified immediately by dialing 2231 from any University phone or by dialing 416-226-6620 ext 2231.

Warnings and/or Precautions:

If neither University Security Services or Director, Campus Operations are available and Community Members have concern for their or others personal safety they should dial 911.
2.2.
Documenting Breaches 

How / What to Do:

All breaches of PNG Declaration conditions must be documented in writing through the University's incident reporting mechanism and will form part of the permanent record for the individual.

Warnings and/or Precautions:

Recognizing that Community Members safety is of utmost concern incident reports may happen after the fact but ought to be completed no later than forty-eight (48) hours after a breach of conditions has occurred.

Requesting Reviews 
3.1.
Submit a Request 

How / What to Do:

A request for review of the decision to issue a PNG Declaration or the specific conditions related to the PNG Declaration may be made by submitting the prescribed form.

Individual for whom a PNG Declaration has been issued
3.2.
Review Request 

How / What to Do:

An Authorized Person who was not part of the original decision to issue the PNG declaration should review the appeal form submitted and consider:
  • the original documentation for any procedural errors which may have occurred and;
  • evidence which became available after the initial PNG declaration was made and;
  • any new evidence which clearly demonstrates the individual's behaviour will no longer be detrimental to Community Members.

3.3.
Appeal Decision Issued 

How / What to Do:

Appeal decisions should be passed to University Security Services who will disseminate the information in accordance with the documented procedure for Declaration Notifications.  Under most circumstances the individual can expect to receive a decision in writing within thirty (30) days of receipt of a request to review.
